Utah’s law regarding drug testing is found in Title 34, Chapter 38 of the Utah Code Annotated. There is also a Drug-free Workplace law stated in Title 34, Chapter 41 and a State Employment Law in Title 67, Chapter 19 of the Utah Code Annotated.

The drug free workplace law in Utah is voluntary.  Once your company decides to participate in the Utah Drug Free Workplace program then your company qualifies for limited legal protections and/or a reduction in workers’ compensation premiums.  Contractors in Utah working State contracts for construction or improvement of any public property or building must comply with the Utah employer alcohol and drug-free workplace act.

The Utah Worker’s Compensation Fund allows rate discounts up to 25% for the company’s safety program.  In order to qualify, then you must have a Drug Free Workplace Program that is communicated to all employees, is available for review by prospective employees, and explains the types of tests an employee or prospective employee may be subject to. All employees must be subject to the policy and management must be tested periodically.

You must use either a third-party testing organization like National Drug Screening for sample collection or perform onsite collections through trained and certified administrators. All positive tests must be confirmed by a government certified laboratory.

 You must have a disciplinary process for those who test positive for alcohol and/or drugs, refuse to be tested, or attempt to alter the results. Utah law has no restrictions on the policy discipline, including discharge. Confidentiality of the results must be maintained and management must be tested periodically as part of the policy. All costs of testing must be borne by the employer. The employer is not liable for monetary damages if the testing proves to be false positive.

There is no plan to introduce medical marijuana legislation for adults. Currently, possession of an ounce calls for a thousand dollar fine and six months incarceration.

Utah is a very employer friendly state and employers can discipline or discharge employees using medical marijuana. This must be specifically outlined in the company drug free workplace policy. Smoking only at home, off-duty or on weekends provides no protection if the workplace drug test comes back positive for marijuana.
