In South Carolina, Employers or individuals who receive state contracts or grants of $50,000 or more must certify that they have a drug free workplace policy and have distributed to all employees, and that they have established a drug awareness program for employees.

In South Carolina, a positive drug test after an accident can result in the denial of a workers comp claim. Per §42-9-60 no compensation shall be payable if the injury or death was occasioned by the intoxication of the employee or by the willful intention of the employee to injure or kill himself or another. In the event that any person claims that the provisions of this section are applicable in any case, the burden of proof shall be upon such person.
