How Federal Drug Testing Regulations Affect Nevada Employers
Under federal law, only certain Nevada employees are required to submit to drug screening. Drug screening is required for those in high-risk professions, such as transportation and aviation. If you are seeking employment as a federal contractor — such as with the Department of Defense of NASA — you will also be required to undergo drug screening. When it comes to employers in the private sector, drug testing regulations are determined by Nevada state law.
State Drug Testing Rules and Regulations in Nevada
Nevada has few drug testing regulations in place at the state level.
- Instant drug testing or point of collection drug testing (POCT) is prohibited in Nevada as all tests must take place at a laboratory.
- Urine, hair and oral fluid drug testing are allowed a medical review officer (MRO) should review all drug test results.
For public employees such as law enforcement officials, drug screening is required. Drug screening for private employees is left up to the employer’s discretion. This means that employers can perform drug screening on applicants, after an accident or injury, at random or if there is reasonable suspicion. If a positive result is found, employers have full authorization to provide a treatment referral, discipline or discharge the employee as necessary. Medical Marijuana Use in Nevada
The state of Nevada allows the use of medical marijuana. Employees are not required to inform employers of medical marijuana use. However, in the event of a drug test, an employee may request that the Nevada Medical Marijuana Program supply their employer with written information about the employee’s enrollment in the medical marijuana program.
Nevada has a law that permits medical marijuana use. However, the law does not require employers to accommodate the use of medical marijuana in the workplace.
