Montana Rules and Drug Screening Limitations

It is important in Montana that when setting up a drug testing policy that an employer work with an experienced consultant to make sure the policy complies with the State laws on drug testing in Montana.  All drug free workplace policies should be reviewed by the company attorney.

In Montana drug testing should always occur in companies that have:

• Dangerous work environments
• Working as a security officer or other security position
• In a position of financial trust
• Working in areas that could affect public health and safety
• Any position that requires driving

Employers in qualifying industries only have certain situations in which they are allowed to screen for drugs. One or more of the following criteria need to be met before ordering a post -accident drug test:

• You must have reasonable suspicion that the employee is under the influence.
• An accident has occurred causing an injury or property damage worth more than $1,500.
• The drug test is a follow-up to a previous positive result

Montana also allows employers to do random drug testing. However, you must test all employees together, and the date needs to be established in advance. You can also contract a drug screening center to do your random drug testing so long as the drug screening program abides by each of the following guidelines:

• There must be an established calendar period in which to conduct drug screens
• The drug testing agency must specify the rate at which they will test during this period
• The selection process must be random
• Anyone in a management position must be in the selection pool
• Each employee must sign a statement agreeing that they received a written description of the drug testing program

Montana employees must be given a 60 day notice of a drug testing policy, and your drug testing policy must be posted for employee review. In addition, no action can be taken against employees with positive results who have proof that the result was not triggered by illegal drugs, as in the case of medical marijuana use.

When reasonable suspicion testing is required the employer must comply with the supervisory training requirement in 49 CFR part 382. Employee education is specifically required.  An employer may require an employee to be tested for controlled substances or alcohol if the employer has reason to suspect that an employee’s faculties are impaired on the job as a result of the use of a controlled substance or alcohol consumption.

Controlled substance and alcohol testing procedures for samples that are covered by 49 CFR, part 40, must conform to 49 CFR, part 40. For samples that are not covered by 49 CFR, part 40, the qualified testing program must contain chain-of-custody and other procedural requirements that are at least as stringent as those contained in 49 CFR, part 40, and the testing methodology must be cleared by the United States food and drug administration.

Post accident drug testing is important in Montana as a workers comp claim can be denied.  An employee is not eligible for benefits otherwise payable under this chapter if the employee’s use of alcohol or drugs not prescribed by a physician is the major contributing cause of the accident.

Medical Marijuana and the Workplace in Montana

In Montana, the use of medical marijuana is permitted. However, employers do have the right to prohibit medical marijuana use while on the job. People with permission to use medical marijuana should have a Registry Identification Card issued by the Department of Public Health and Human Services.

Many restrictions apply to the users of medical marijuana, including not being permitted to operate vehicles, heavy machinery or perform other safety-sensitive tasks while under the influence of marijuana. Employers are not required to accommodate marijuana use in the workplace. Public use of marijuana is prohibited. Employers test for marijuana – THC.
