The State of West Virginia has no restrictions on employer drug testing although public contractors on state projects are required to have drug testing. A certified laboratory should be used for drug testing for employees of public contractors. The drug testing should include the following drugs: marijuana, cocaine, opiates (including hydromorphone, oxycodone, and hydrocodone), phencyclidine, amphetamines, barbiturates, benzodiazepines, methadone and propoxyphene.
In West Virginia public contractors must implement a drug free workplace program that includes employee education on substance abuse and supervisor training that must include:
- Recognizing a possible drug or alcohol problem;
- Documenting behaviors that demonstrate a drug or alcohol problem;
- Confronting employees with the problem from observed behaviors;
- Initiating reasonable suspicion and post-accident testing;
- Handling the procedures associated with random testing;
- Making an appropriate referral for assessment and assistance;
- Following up with employees returning to work after a positive test; and
- Handling drug-free workplace responsibilities in a manner that is consistent with the applicable sections of any pertinent collective bargaining agreements.

In West Virginia unemployment compensation can be denied for misconduct which includes intoxication which can be derived from a positive drug or alcohol test or reporting to work in an intoxicated condition, or being intoxicated while at work; reporting to work under the influence of any controlled substance, as defined in chapter sixty-a of this code without a valid prescription, or being under the influence of any controlled substance, as defined in said chapter without a valid prescription, while at work; adulterating or otherwise manipulating a sample or specimen in order to thwart a drug or alcohol test lawfully required of an employee; refusal to submit to random testing for alcohol or illegal controlled substances for employees in safety sensitive positions.
Workers compensation claims can be denied in West Virginia when death or injury is caused by the intoxication of the employee. The employer must have a reasonable and good faith suspicion of the intoxication and a blood test for drugs and alcohol should be conducted.
In the mining industry in West Virginia, drug testing is required for pre-employment drug testing and random drug testing. Urine drug testing at a lab is required, instant drug testing is prohibited. Drugs to be tested must be Amphetamines, cannabinoids/THC, cocaine, opiates, phencyclidine (PHP), benzodiazepines, propoxyphene, methadone, barbiturates, and synthetic narcotics. Synthetic narcotics would include hydromorphone, oxycodone, and hydrocodone. DOT drug testing and SAMHSA standards must be followed for drug testing in the mining industry in West Virginia. All failed drug or alcohol tests to be reported to the agency’s director for immediate temporary suspension of mining certificates pending an appeal before the State Board of Appeals.
