Nebraska Drug Screening

Regarding State Laws for drug testing, Nebraska has a very open workplace drug testing law; all types of testing are permitted.  For alcohol testing a breathalyzer and confirmation testing are required.  Persons refusing to be tested may be subject to adverse employment action including “denial of continued employment.”

Workers comp benefits can possibly be denied for a positive drug or alcohol test when the employee was in a state of intoxication.  48-127. Compensation; willful negligence; intoxication; effect. “If the employee is injured by reason of his or her intentional willful negligence, or by reason of being in a state of intoxication, neither he nor she nor his or her beneficiaries shall receive any compensation under the Nebraska Workers’ Compensation Act.”  The State of Nebraska unequivocally endorses the philosophy that the workplace should be free from the detrimental effects of illicit drugs.

A point to further strengthen the State of Nebraska Drug-Free Workplace Policy, is that all businesses, individuals, and organizations engaging in, or seeking to engage in, business with the State must establish and provide proof of a drug free workplace policy.

Our medical review officers (MRO) works side by side with 12 full time MRO assistants. When immediate drug testing is needed, tests are completed without hesitation, and results are sent using one of our convenient and cost effective methods. An MRO can review the specimen lab test results, and make a positive or a negative finding report based on an investigation, or solely on the findings of the lab test results.

We perform DOT consortium drug test for businesses that rely on the sobriety of their DOT drivers. DOT regulated employees must have at a minimum a 5 panel DOT urine drug test performed at a SAMHSA certified laboratory and reviewed by an MRO (medical review officer).

Non DOT employers have many options.  For this purpose, we provide several options for testing for drugs and alcohol. Our five panel hair test can easily detect the presence of drugs.   A 5 panel hair test that can detect drug use for up to 90 days. When the results are done, we forward them to the requester immediately. This could not be possible without the high efficiency software we use.

We use the same testing software and equipment found in federal mandated collection sites. These labs include LabCorp, Quest and many others. We perform tests on urine, saliva and hair follicles. We test for Opium, Cocaine, Codeine, PCP, Marijuana, methamphetamine, and other illegal drugs. We also offer consultative services to businesses that want to establish a drug free workplace, with a zero drug and alcohol tolerance policy.

The Nebraska Medical Marijuana Amendment did not appear on the November 4, 2014 ballot in Nebraska as an initiated constitutional amendment. The measure would have allowed patients to use, possess and grow marijuana for medical purposes with a doctor’s recommendation. The petition was filed by NORML Nebraska on July 17, 2012. Proponents did not collect enough signatures to put the issue on the ballot.
